CAPTION COMPANION - TECHNOLOGY USE AGREEMENT
The purpose of this agreement is simply to establish that you take responsibility for how your Caption Companion(s) is/are utilized. That frees you up to use Caption Companion in whatever way you or your organization chooses without us having to put any restrictions in place.
This technology use agreement is a disclaimer of liability that applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay of operation or transmission, computer virus, communication line failure, theft or destruction, or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action related to the Caption Companion product and/or service. Customer specifically acknowledges that Premier Visual Voice is not liable for any defamatory, offensive, or illegal conduct of customer or third parties and that the risk of injury from the foregoing rests entirely with you, the customer.
Neither Premier Visual Voice nor any of its agents, affiliates or providers shall be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of product and/or service, or inability to gain access to or use the product and/or service, or out of any breach of any warranty. Customer hereby acknowledges that the provisions of this section shall apply to all content of the product and/or service.
Premier Visual Voice does not intend for uses of automatic captioning devices or automatic captioning services to create obligations under the Health Insurance Portability and Accountability Act, as amended ("HIPAA"). Premier Visual Voice makes no representations that Caption Companion satisfies HIPAA requirements.
Automatic captioning should be considered a rough draft of spoken content which is intended to facilitate realtime access to oral and aural communication. It does not—nor does it intend to produce—a verbatim record of the proceedings. Transcripts created by automatic captioning on a Caption Companion device may not be used in a court of law.
